Work Permits for Asylum Applicants – 2/26/2026
The government has proposed changes that would make it very difficult, and sometimes impossible, for asylum applicants to get a work permit. These changes have not taken effect. The earliest they could take effect is April 24, 2026.
What this means for you:
- If you already have a work permit based on a pending asylum application (category c(8)) that work permit remains valid.
- If your current work permit is expiring in 1 year or less, consider applying to renew as soon as possible, before any changes take effect.
- If you have a pending asylum application but have not yet requested a work permit, consider applying for a work permit as soon as possible before any changes take effect. Under the current rules, you can generally apply for an initial work permit 150 days after filing your asylum application. Consult a qualified legal representative to confirm you are eligible.
